Please provide a brief summary of the initiative including the problems/challenges it addressed and the solutions that the initiative introduced (300 words maximum)
El Proyecto Sexta Jurídica surgió con la aprobación del primer Código de Proceso Civil de la historia de la democracia brasileña, que entró en vigor en el año 2016 y trae cambios sustanciales, generando nuevos paradigmas a partir del nuevo sistema procesal. Como el momento era de transición, se veía la importancia de la preparación en la entrada en vigor del nuevo código de procedimiento civil. El evento proporcionó discusión de los temas más relevantes planteados por el nuevo Código, cambios que, con certeza, generaron una celeridad mayor al proceso, destacándose las técnicas de mediación y de conciliación que resultaron en resolución de litigios de forma eficiente y rápida. La segunda etapa del Proyecto Sexta jurídica se ha atendido a los reclamos de la comunidad jurídica, de la sociedad organizada y de las instituciones que trabajan con salud mental y con apoyo a la inclusión de personas con discapacidad. Así, se organizó el evento cuyo tema fue: "Estatuto de la persona con discapacidad".Se trató de experiencia inaugural y con importantes efectos: la capacitación en sí; el protagonismo valeroso y generoso de la Defensoría Pública que permitió una discusión plural y con masiva participación de los destinatarios del Estatuto. El ineditismo patrocinado por la Defensoría Pública de Bahía como la primera Institución que se anticipa y convoca una discusión plural, dialogada con los técnicos del derecho, de la salud, de la psicología y ofrece el espacio del habla para las personas que enfrentan y conviven con deficiencias. En el Seminario nacieron reivindicaciones diferentes y nuevas responsabilidades para la Institución. Aunque la ley de la inclusión sea una herramienta esencial para vencer la cultura prejuiciosa y ignorante que aún permea el tratamiento de las diversidades en la sociedad brasileña, se reconoce la necesidad de fortalecer el contenido de la ley de inclusión porque existen riesgos de retrocesos y de conductas que implican abusos y discriminación de las personas con discapacidad. La III Etapa del Proyecto se dedicó a la saga enfrentada por la persona transgénero. Así, se organizó un evento multidisciplinario para discutir la discriminación, la muerte precoz, la exclusión y la falta de amparo a la población de travestis y transexuales.

1) Preparación de la entrada en vigor del nuevo código de procedimiento civil; que estudia el proceso civil a la luz de la legislación actual, en una visión amplia de presente y futuro, iniciando por los principios fundamentales del proceso, pasando por las modificaciones sustanciales relacionadas con la fase de conocimiento y ejecución hasta las tutelas de urgencia. 2) Presentar a la sociedad la propuesta emancipatoria anunciada por la ley brasileña de inclusión; discusión plural y con masiva participación de los destinatarios del Estatuto, es decir, la sociedad, formada por personas con discapacidad y sin discapacidad. 3) Realizar un debate civilizado y respetuoso a partir de una perspectiva médica/ psicosocial / jurídico / político con el propósito de colaborar con el perfeccionamiento del significado de la Dignidad Humana en el siglo XXI.

A través del perfeccionamiento del significado de la Dignidad Humana en el siglo XXI; promoviendo el debate de temas contemporáneos que ocupan el escenario jurídico, político y social; reflexión acerca de la diversidad humana y comprensión de las formas de vivir que no se encuadran en la heteronormatividad. El Proyecto destaca los temas y problemas relevantes que afectan con mayor perjuicio a las personas vulnerables.

La iniciativa tiene como objetivo vencer prejuicios y desigualdades. Los servicios públicos también son alcanzados por ineficiencia y exclusiones derivadas de prejuicios y de ignorancia acerca de los nuevos derechos que apuntan a la promoción de la dignidad humana. Por lo tanto, la divulgación de nuevas premisas, la capacitación de servidores y especialmente la sensibilización de gestores, operadores del derecho y de la salud pasan por una oportunidad de reflexión y de cambio de hábitos y conductas. La concientización de las formas de inclusión y de la necesidad de inclusión y amparo a los vulnerables (mujeres, personas con discapacidades, homosexuales, transgéneros, travestis, ancianos y niños, negros e indios).

La iniciativa tiene como eje precisamente perfeccionar el servicio público en la prestación de una tutela jurisdiccional que garantice la igualdad de las partes y la superación de prejuicios. Permitir que las decisiones judiciales garanticen la efectividad de una ciudadanía plena y de acuerdo con los fundamentos de la república brasileña. La inserción de nuevas técnicas procesales que busquen la resolución de los conflictos basados en la cultura del protagonismo de los interesados con máxima protección a los intereses que correspondan a sus potencialidades, posibilidades, circunstancias y cultura. Además, el enfoque lleva al reconocimiento de nuevos derechos y la lucha por la reducción de las desigualdades con el combate de la violencia que en general impregna a los que no logran encajar en los patrones de la heteronormatividad, de la enseñanza formal, de la cultura dominante que tiende a excluir todo y todos que de alguna manera se distancian de sus reglas.

El Proyecto impacta de forma positiva al conjunto de la población vulnerable económicamente y que depende de asistencia jurídica para el ejercicio de derechos fundamentales. Son varias acciones afirmativas que se diseminan a partir de cada etapa del proyecto. Ejemplos: uso de las técnicas de la Escuela de Harvard para promover la mediación / conciliación como formas adecuadas para diluir conflictos familiares y de relaciones continuas; la inclusión de las personas con discapacidad física y visual en los servicios prestados por bancos e instituciones financieras, sean como trabajadores, sean como consumidores que puedan valerse de los servicios bancarios con igualdad de acceso; el reconocimiento del derecho de las personas transgénero a modificar documentos para uso del nombre social y modificación del género para disponer de certificado de nacimiento, documento de identidad y pasaporte conteniendo datos que reflejen su forma de existir a partir de su sentimiento, auto-realización y desempeño social; reducción del prejuicio y de la homofobia y la transfobia.

El evento, con su carácter inédito, patrocinado por la Defensoría Pública de Bahía como la primera Institución que se anticipa y convoca una discusión plural, dialogada con los técnicos del derecho, de la salud, de la psicología y oferta el espacio del habla para las personas que se enfrentan y conviven con deficiencias, prejuicios y discriminaciones. De los Seminarios nacieron reivindicaciones diferentes y nuevas responsabilidades para nuestra Institución, mostrando que hay un canal inexplorado y carente de Defensoría Pública que busca realizar una aproximación esencial y extraordinaria con personas que necesitan de sus servicios.

El FAJDPE (Fondo de asistencia judicial de la Defensoría Pública) ha destinado recursos financieros para adquisición de pasajes, hospedaje y pago de hora-aula para los Ponentes que se desplazan hasta la Sede de la 2ª DPE Regional. Se cuenta con la aportación de las cantidades dispensadas por los Defensores Públicos para viabilizar la presencia de Conferencistas a ejemplo de pago de almuerzo, confección de carteles y costos adicionales como forma de conceder organización y cuidados en nombre de nuestra Institución. Hay que registrar los recursos humanos. En ese sentido hay apoyo esencial de los servidores, pasantes y todo el equipo de la Sede de la 2ª Regional. Además, hay la indispensable colaboración de la ESDEP y de la ASCOM para la realización de cada Etapa del Proyecto. En todas las etapas se realizaron alianzas con la ESDEP, ASCOM de la Defensoría Pública y Rectoría de Extensión e Investigación de la Universidad Estatal del Sudoeste de Bahía.

Se ha transferido al medio académico haciendo que los estudiantes tengan acceso a los debates y contribuyan a la elaboración de soluciones. Además, permite que los jóvenes de diferentes clases sociales, económicas y culturales conozcan la realidad de la población carente, desasistida y fragilizada por cuestiones de género, color, edad.

Es sostenible, principalmente desde el punto de vista social, pues busca promover el debate de temas contemporáneos que ocupan el escenario jurídico, político y social, así como tiene el propósito de colaborar con el perfeccionamiento del significado de la Dignidad Humana en el siglo XXI en sintonía con la " Seguridad jurídica

El proyecto, por tratarse de una práctica anual y permanente, es sostenible en términos de durabilidad de tiempo, pues, en cada momento han surgido temas y debates nuevos, que necesitan la actuación de la Defensoría Pública. Ya se ha convertido en un evento cobrado por varios segmentos sociales que aguardan la edición de cada etapa, sugiriendo temas y nuevos focos que puedan cooperar con la construcción de una sociedad más igual. Las cartas de referencias y declaraciones de ejecución firmadas por varias representaciones y incluso por persona directamente contemplada con el Proyecto revelan su sostenibilidad.

No existe experiencia democrática válida y eficiente si los destinatarios de las acciones de inclusión, igualdad y emancipación no participan en la concepción, interpretación y la construcción de las metas y actitudes. También no es posible considerar un servicio público esencial si tal servicio no se dispone a revisar sus actuaciones y dialogar con su usuario. La escucha, la capacidad de acoger ideas y sugerencias es absolutamente fundamental para hacer la gestión estatal reconocida y valorada. También es indispensable el reconocimiento de la importancia de la multidisciplinariedad para comprender que la respuesta solicitada por el usuario de la Defensoría Pública exige la cooperación de varias áreas del conocimiento humano: la ciencia jurídica, la psicología y la asistencia social es un trípode fundamental para la correcta ejecución de las metas cualquier servicio.
